GENERAL PROVISIONS

1.1 These general terms and conditions of sale (hereinafter referred to as the ‘General Terms and Conditions’ and/or ‘GTCs’) govern the on-line purchase made through the site www.belinit.it (hereinafter referred to as the ‘Site’), owned and managed by the company Belinit S.r.l., and apply to all sales of products (hereinafter referred to as the ‘Products’ or ‘Product’) concluded at a distance through the Site

1.2 The use of the distance selling service described in these General Terms and Conditions is reserved exclusively for consumers (hereinafter referred to as ‘Customers’ or ‘Client’), understood as natural persons acting for purposes outside their trade, craft, business or professional activity that they may have carried out, who are over 18 years of age.

1.3 The Customer is obliged to carefully read the General Conditions that have been made available to him on the Site, in order to allow their knowledge as well as their memorisation and reproduction by the Customer in accordance with article 12, paragraph 3, of Legislative Decree 9 April 2003, n. 70 (‘Implementation of Directive 2000/31/EC on certain legal aspects of information society services in the internal market, with particular reference to electronic commerce’ – hereafter, ‘E-commerce Decree’). By using the Site, the Customer unconditionally adheres to the terms and conditions of use indicated below, which may, however, be modified, at any time and without notice, by Belinit S.r.l. according to its unquestionable discretion; your use of the Site after the aforementioned modifications will be considered an unconditional adhesion to the terms and conditions as modified. The information, images, photographs, trademarks, products and in general the elements and material that the Customer will find on the Site are disclosed solely for promotional and advertising purposes as well as for information purposes; the Customer may download or copy the aforementioned information and material solely for personal and non-commercial use.

1.4 Contracts concluded with Belinit through the Site are governed by Italian law and, in particular, by Italian Legislative Decree No. 206 of 6 September 2005, as amended (hereinafter referred to as the ‘Consumer Code’) and by the above-mentioned E-commerce Decree.

PRODUCT INFORMATION AND AVAILABILITY

3.1 Information on the Products, with the relevant product codes, is available on the Site where the Customer will find details of the main characteristics of the individual Products, their physical state, the list of ingredients, nutritional and supplementary information, origin, shelf life and storage conditions.

PRICE

4.1 The prices of the Products are expressed on the Site in Euro and are inclusive of all applicable taxes or duties. To the prices of the Products must be added the delivery charges shown separately in the order form.

MODE OF PURCHASE

5.1 The essential characteristics and prices of the Products are set out in the offer for each Product on the Site.

5.2 Before sending an order proposal, Customers are invited to ensure that they have read and understood the instructions provided during the purchase procedure and these General Conditions, as they will be binding once the contract is concluded. For the purchase of Products, the Customer must fill in and send the order proposal form in electronic format to Belinit, following the instructions on the Site. The Customer will have to insert the Product in the appropriate ‘shopping cart’ and, after having read and accepted the General Conditions, with particular reference to the contribution to delivery costs and the conditions on the right of withdrawal, as well as having read the Privacy Policy, will have to select the desired payment method and choose the option ‘proceed with the order’.

5.3 If the Customer needs to correct any data entry errors, he/she shall follow the appropriate modification procedure indicated on the Site, before submitting his/her order proposal. In particular, the Customer is entitled to change the quantity of the Products he/she intends to purchase by adding or removing one or more Products from the ‘shopping cart’.

5.4 By sending the order proposal to Belinit, the Customer acknowledges and declares that he has read all the information provided to him during the purchase procedure and that he accepts the General Terms and Conditions in full.

5.5 Without prejudice to the uses of data described in the Privacy Policy and subject to the express consent of the Customer, the order proposal form and the Customer’s data relating to the order proposal will be retained by Belinit for the period of time prescribed by the applicable law.
